With Roles, when we use
“Tripelhop” we mean us as developers and suppliers of Apps on the Zendesk marketplace
“Users” we mean you, anyone that purchases and uses the Tripelhop Apps
“Third Party” we mean anyone beside Tripelhop and the Users. These can be suppliers, subsidiaries,…
“Zendesk” we mean the Zendesk platform for which our Apps have been developed
Definitions
“Apps” means any Tripelhop application you get from our website at tripelhop.com or www.zendesk.com/apps.
“Content” is anything you upload or share through the app.
“Data Processor” is any third party we use to handle your personal info.
“Intellectual Property” is all the cool stuff we create and own (like our app designs and features).
“Membership Data” is the info you give us when subscribing to a Tripelhop app.
General Terms
Tripelhop runs cool online apps that work with Zendesk.
By using our Apps, you agree to follow these rules.
If you don’t agree with the Terms & Conditions, you shouldn't use our Apps.
We can restrict or disable your access, when these Terms & Conditions are being violated
We’re not liable for loss of content.
Using the App
We give you a non-exclusive, non-transferable license to use our apps according to the Terms & Conditions.
Our apps might have links to other websites and content from other people. When doing so we are only linking to those sources but do not control their content and are not responsible for those pages.
The Apps might not always be available (like when we’re doing maintenance).
We can update and change our Apps whenever we want, just like tweaking a beer recipe.
We can change prices but will inform our users upfront by contacting them over the email they used to buy the App.
You can cancel the subscription anytime via the Zendesk Marketplace.
We can restrict or disable your access, when violations to the Terms & Conditions have been noticed
User Conduct:
Don’t use the Apps for anything illegal or unethical.
We’re not responsible for what the users of our Apps do (online or offline).
You must not:
Use the App to create something similar.
Try to figure out our secret ingredients (source code).
Share, rent, or lease the App to others.
Modify the App without our permission
Mess with the App’s proper functioning.
Bypass any privacy settings.
Send spam through the App.
Don’t use our Apps to share content that:
Is harmful, offensive, or illegal.
Exploits others.
Shares unauthorized personal info.
Violates intellectual property rights.
Contains viruses or harmful code.
You’re responsible for what you share and do on the app.
Records:
We may keep records about you, including complaints. (See Privacy Policy for details).
We can share info if required by law or authorities. (See Privacy Policy for details).
Payment:
The purchase price of our Apps will be clearly documented
Prices are in US Dollars and don’t include tax.
You need to pay before installing the App.
We can change prices anytime but you will be informed upfront
If your payment fails, we’ll notify you, and you have 7 days to fix it. If not, your access will be disabled.
Free trials might be available via the Zendesk Marketplace
We don’t offer refunds.
Intellectual Property Rights:
We own all the cool stuff in our app.
Apps and code are owned by Tripelhop, unless it is owned by a third party;
Logos and names belong to Tripelhop too.
You need our permission to reproduce any part of our Apps.
Zendesk and related trademarks are owned by Zendesk.
Termination:
We can terminate or suspend your access anytime without notice.
We can change or discontinue any feature of the app anytime.
We can cancel subscriptions anytime.
Limitation of Liability:
You’re responsible for any damage caused by your use of the Apps.
We’re not liable for:
Data loss, content loss.
Unavailaibility or instability of the Apps
Indirect, punitive, incidental, or consequential damage.
Our liability is limited to the amount our users paid for the App.
If our users are confronted with bugs in the app, they should report this to to support@tripelhop.com.
We don’t guarantee a resolution time but we will react upon your request or issue within one week.
Applicability
Priority of Terms: This document has got priority over any other information. If anything else in the app conflicts with these rules, these rules still precede.
Invalid Provisions: If any part of these rules is invalid or can't be enforced, we'll adjust it just enough to make it valid without affecting the rest of the rules.
Governing Law: These rules are governed by Belgian law, and any disputes will be handled by Belgian courts.
Liability: We're not responsible for any losses or expenses you suffer due to a breach of these rules.
Non-Waiver: If we don't enforce a rule, it doesn't mean we've waived our right to enforce it later.
Amendments: We can change these rules at any time by sending you a notice (via email). The changes take effect immediately. If you continue using the app after the changes, it means you accept them. If you don't accept the changes, stop using the app.
Entire Agreement: These rules, along with our Privacy Policy, make up the entire agreement between you and Triplehop, replacing any previous versions or other communications.
